We have a small terraced house built in 1970 (76 sqm) and now have 2 small children, but we wish for a third. On the ground floor there is a toilet, kitchen, and the living/dining room. On the first floor we have a bathroom and 3 rooms that could be used as bedrooms: Office: 6 sqm Bedroom: 14 sqm Children's room: 12 sqm. We originally planned to set up the bedroom and office under the roof in order to have space for 3 children's rooms on the 1st floor. The converted attic can currently only be accessed via a pull-out ladder + hatch in the ceiling. The ceiling height in the attic is only exactly 2 meters in the middle, then the roof slope (attic) begins immediately. Now I have found the following in the building regulations for Baden Württemberg: In order to be recognized as living space, the new rooms in the attic must have an adequate clear height over at least half of their floor area. For this purpose, a clear height lower than 2.40 meters – but at least 2.20 meters – may be permitted if there are no concerns for residential use. Room parts with a clear height of up to 1.50 meters are not considered in the assessment. However, we cannot meet this condition. Space would of course also be needed for building a staircase that meets the requirements, which would then be missing in the other rooms on the 1st floor. In the hallway of the 1st floor there is no space for a staircase (it is only 90 cm wide). Is it advisable to use our attic as living space (e.g. because of insurance in the event of fire)?
