Hello house construction expert,
Next year we will move into a [REH] from a developer. We already signed the purchase contract or work contract according to §631 of the Building Code last year.
Now, in the declaration of division, we received building plans (service phase 1: preliminary planning according to HOAI). However, they were copied so small that no measurements can be taken.
When we inquired about plans in original size, we were met with great incomprehension from the developer.
According to prevailing case law, the documents (building description and plans) provided upon acquisition of the building are sufficient for the buyer. Now we ask ourselves the question:
Do we have the right to the delivered plans in original size?
