Chimney drawn incorrectly

Hello, we have the following problem: the architect incorrectly marked the chimney on the upper floor. When the masons wanted to start work on the upper floor after the chimney had been raised, they realized that the chimney was misplaced by about 1 meter, and this now completely disrupts the floor plan, which was previously square and practically good, and it now becomes quite awkwardly angled. Our construction company did not notice this error when submitting the building application, etc. We would like to completely relocate the chimney, but allegedly this is not possible for structural reasons. However, the construction company has not specified these reasons, so I do not believe them and would actually insist on a relocation. The house is already bricked and roofed. Now my questions: is relocating/demolishing and rebuilding a chimney really that problematic? If we now have to live with the awkward unwanted floor plan, can we then demand reimbursement for the drawings and also request further compensation? After all, we will have to live our lives in the awkward rooms and will surely often be annoyed since the chimney now comes out right at the bottom of the stairs. Thank you very much for your opinions. That a chimney/fireplace is not necessary for insulation reasons is clear to me...

How this is legally, I cannot say – layman's opinion often contradicts the truth – and even the truth is often expensive and difficult. Just post the floor plan, maybe someone here has a design idea (of course only in case it really would be disproportionate to move the chimney).

The building is without a basement, on a slab foundation. I have attached once the floor plan as it was submitted to the building authority (zwischenablage01) and the current solution with the crooked rooms (zwischenablage02). Here, the staircase is steeper. In the floor plan that was planned, I have drawn the actual position of the chimney with a pen. This makes it clear that the planned door to the bedroom is no longer feasible... In the crooked solution, I have already drawn in some furniture so that we can become more accustomed to it... but it doesn’t really work either... We would like to move the chimney so that it goes up next to the staircase and then comes out upstairs in the children's room/office. So basically the chimney rotated 90 degrees and then to the left next to the slanted wall...(zwischenablage3) I would really be grateful for any solution – I am simply at my wit's end and the architect has so far been no help because the solution also came from me... Unfortunately, we never saw a drawing like in Zwischenablage03 before... this also now comes from me...

Clipboard 1 was planned by you and is also fine.
Clipboard 2 shows the status on the upper floor - where is the fireplace located on the ground floor?
Clipboard 3 shows - what exactly? What would you now want?

Do I understand correctly that the child always has to go through the bedroom when it wants to go to the toilet, or don’t you have a child?
The chimney is for a fireplace?
