Building plot & neighbor is about 90 cm higher

Hello everyone,

I hope I am in the right place!

We have the opportunity to get a building plot in our place of residence. Actually nice, but we were there earlier and saw that the neighbor (or rather several neighbors from the parallel street) are significantly higher. There is a difference in height of about 90 cm to approximately 1 m. Oh, and it is located in the very, very flat district of Cloppenburg, so no mountains/slopes or similar conditions.

We were also in the parallel street and saw that these "higher" plots are also very high from the street side. The actual street surfaces have not yet been made; they will only be tackled once the entire building section is developed.

There is already a left neighbor (still in the construction phase) next to this free building plot. But he has not even leveled anything. If we now level, he would get all the water.

What now, what rights/obligations do the already finished very high neighbors have, or what possibilities are there to avoid waterlogging?

The elevation above sea level, if there are specifications, is stated in the development plan. Otherwise, if possible, you always build above street level so that you don’t have problems during rain. And if the street is not there yet, it will probably be about 30cm higher than the current level, maybe there will be sewers added?

The sewer works are already completed, currently there is a paved construction road – but it is supposed to be renewed once everything is finished.

Hello,

there must be a good reason why all the houses are built higher; raising the level of a plot is not exactly cheap. The textual determinations of the development plan are always important. I could imagine that the answer to "why so high" can be found there.

As far as your neighbor is concerned, it can be relatively irrelevant to you - provided you want to build a detached house - at what height he sets his house. If, on the other hand, you want to build an attached house (semi-detached), you have to found at the same height - with in my opinion a small margin of flexibility; that again depends on the specifications for eaves and ridge height as well as the design requirements of the building planning office.

if the construction road is already "paved," all supply and disposal lines are actually already in place. usually, a fine layer is applied over the construction road - this is generally a few centimeters thick. in addition, there are the sidewalks which, depending on the situation, are about 15cm higher than the finished road or only a few centimeters... it is all at the discretion of the responsible authority, where it is best to inquire directly.

Thank you for your response, unfortunately not all plots of land on this parallel street are higher, only those located in the dead-end street (there are 4 in total), the remaining 4 houses on this side are "normal" or the elevation gradually decreases from plot to plot...

We have also already learned that everything is regulated in the development plan, which we will receive at the end or the beginning of next week. Let's see what it says!

In the meantime, I also spoke again with my parents about how it was for them about 16 years ago. And their neighbor (to the east side, also on a parallel street) was also about one meter higher than they were. But after the foundation was excavated, there was so much topsoil left over for leveling that it is now only about 40 cm. And they simply built an embankment towards this neighbor.
