Building law Baden-Württemberg boundary distance etc.?

Hello, I am considering making a purchase offer for a building plot. Now, on the neighboring plot a house has been built and has about a 1m boundary distance. In Westphalia, I would expect that a building encumbrance is registered on the property onto which the clearance area falls, and I am not allowed to overlap the area with my clearance area.

Can someone help me with this?

So in Lower Saxony you are not allowed to do that - so 5 meters are then the minimum distance to your property area.

I am not entirely sure if I understood the question correctly and I also don’t know if there are municipal differences - but here it is also five meters. And if the neighbor did not build illegally, your property’s previous owner probably had to register an encumbrance.

Hello Alex,

without plans/site inspection, it cannot be assessed. It could be anything from an unauthorized illegal construction to a completely legal building. Get in touch with a local architect and/or surveyor. If necessary, you can also obtain a free telephone building encumbrance information yourself - but this may not help you at all, depending on the response.
