Bird "Infestation" under the attic

We have moved in recently. Unfortunately, we do not have exterior plaster yet. The masonry and the roof edge have a gap. You can see the insulation wool there. Birds have now nested there.

It will take a few more weeks until the exterior plaster arrives.

Should one react now?

If the animals are already breeding, it is forbidden to remove the nest. (5-50000€ fine possible) It is best to contact the city/municipality; they know the responsible nature conservation authority. They will tell you what the situation is.

I can't tell from the photo, but if those are swallows, no exterior plaster will go there, at least not before they are finished breeding. They are strictly protected and if a local environmentalist finds out about it, you will have a real (!!!) problem.

You are not even allowed to remove the nests when they are empty. You have to leave them hanging nicely until they are used again. And if they happen to fall down on their own, you will have a charge on your hands for unauthorized removal of swallow nests. This happened to us here, but luckily we were able to prove that they really fell down on their own.

Between the wood and the green insulation material, there is a gap to be seen, isn't there?

The birds sit "inside" there, or at least they fly in and out there.

What advice can one give you without inciting illegal actions?

Let's put it this way: In such a case, I would wait for the breeding season to end, remove the nest after the young birds have fledged, and clean up.

Of course, no one should imitate this...
