Benefit from the 2020 VAT reduction

Hello dear forum community,

I purchased a house in 11/2019, the handover will take place in 12/2020.
Can I still benefit from the current VAT reduction?

My purchase contract includes the following clause:

“The purchase price for the object of purchase amounts to 209,000 euros. The purchase price was calculated based on a VAT rate of 19%.
Should this tax rate be changed, the purchase price portions due after the time of the change will be adjusted to the extent that the seller is more or less burdened; however, this does not apply to the first partial payment and not to amounts due within 4 months from today.”

All partial payments before 07.2020 should have been calculated with 19%.
By 31.12.2020, 16% must be shown/applied.
The decisive factor is then the final installment, which may be adjusted (downwards if partial payments were calculated with 19%).
However, our kitchen manufacturer simply increased the net price, so that the invoice was shown with 16% VAT and the gross price remained the same as before the VAT reduction. When asked, the studio also said, "No, they do not pass on the price reduction. We increase the net price so that the agreed gross sales price is achieved again."
However, our general contractor passed on the VAT reduction to us!
Just ask!

Hello,
I'm checking in here as well.
I have already received 2 different offers from the same [GU] for a new build.
Once at 19%, once at 16%.
Unfortunately, it looks like the VAT will be raised back to 19% in 2021 :(.
The invoice date is probably decisive, right?
It's actually a shame, you could have saved around 10k.
Are there any other possibilities to take advantage of the savings?

There is a rather long thread about this here in the forum. The VAT will definitely be increased in 2021 - the state will soon need every cent. Although: nobody knows for sure ;) The "savings" are practically not returned to you in cash. Anyone who has financed the house completely anyway can then "shift" the savings to another cost block. That means you can try not to plan for the 10k / remove something from your plan.

Hello, thank you very much for the previous answers. The money was not intended to be spent on anything else, but I would use it to repay from a special payment etc. According to my Bauherren-Schutzbund: "For private builders, this means: If their construction project is completed between 1 July and 31 December 2020, a value-added tax rate of 16 percent applies to the entire contract. If the construction project is only completed and accepted in 2021, the VAT rate is 19 percent. The date of invoicing is not relevant here. For interim invoices, the applicable VAT rate is that of the period in which the service is provided."

I recommend taking a look at §29 UStG. There may possibly be a civil law claim to the lower gross amount.
