Bavarian Building Regulations - What is Allowed?

Hi,

The following situation:
- Rectangular plot
- House with garage and hip roof
- Side 1: 8.4m long garage at the boundary with a height <3m => should be okay
- Side 2: House wall with a height of 5.3m and roof with a pitch of 25° distance to the property boundary 5.4m => should be okay
- Side 4: House wall with a height of 5.3m and roof with a pitch of 25° distance to the property boundary 6.7m => should be okay
- Side 3: 10.5m long house wall with a height of 5.3m and roof pitch of 25°. Distance to the property boundary 3.2m. Property boundary at the street.
On side 3, an exception over 16m privilege or exception for public traffic area could be applied.

Do these 10.5m then also count towards the 15m?
10.5m + 8.4m = 18.9m and thus more than 15m. Or is this still permissible?

If page 3 faces the street, then the setback area extends to the middle of the street and is thus complied with.

You mean 15 meters of edge development.

The 10.4 meters refer to the clearance area.
In my opinion, two different factors, so they do not count in my view.

Can someone explain this to me based on the Bayrische Bauordnung? For me, this case is not clearly described. From when is a house wall/development considered a development with a non-compliant distance surface depth?

1. Don't you have an architect? If you have read Art. 6 of the BayBO, you will certainly have noticed that many individual circumstances play a role in the distance areas, which you can hardly all list here.
2. Don't you have a site plan? Many circumstances can be taken from a good site plan without the need for many words.
3. Attempted explanation:
Assumptions: a) The plot is flat and horizontal
b) The development plan does not contain any distance area relevant provisions
c) There is no distance area relevant local statute
d) You have two entrance steps
e) You have 40cm roof overhang
f) Your residential building is freestanding
H = base + house wall + SchnittMitDach* = 0.36m + 5.30m + 0.19m = 5.85m
distance area = 1H = 5.85m
narrow side = 0.5H = 2.92m at least 3m
Since no building side is longer than 16m, your residential building therefore casts two 5.85m and two 3m deep distance areas. You can choose the sides. The distance area to the street may extend up to the center of the street, the others must lie on your property.

The 15m only apply to the privileged buildings mentioned in Art. 6 (9). If these buildings comply with the specified limits, they do not trigger a distance area and may therefore be built on the boundary or close to it.

*SchnittMitDach: The wall height is measured up to the upper edge of the roof covering in extension of the outer wall. Depending on the roof construction, the roof overhang is added to the wall height as follows:
SmD = roof overhang * tan (roof pitch) = 0.40m * tan(25°) = 0.189m
