BA deadline has passed, and now?

Hello dear forum,

We submitted a building application in May and a few days later the building authority confirmed to us that the documents had been received in full and that the legislature had given them 3 months to make a decision (It even said afterward that they intended to meet this deadline *rolling on the floor laughing*). These 3 months expired last Wednesday and we have not yet received any feedback. Can someone tell me what this means for us now? Unfortunately, I couldn’t find anything about this. Do we now automatically have approval or is the deadline worthless??

Call your responsible [Landratsamt] tomorrow morning and ask there. They can help you as a higher authority. Otherwise, you will need a lawyer specializing in construction law.

This is pure frustration, the clerk at the local building authority who only works 3 days a week doesn't answer the phone, but sometimes the line is busy, the b***h at reception tells me that only the call ignoramus is responsible and she won't say anything else about it. So I try the district office and they tell me that the local building authority is responsible for that, I'm losing my mind...

I'm sorry for you. If I were in your place, I would, if possible, 1. go to the municipality in person and make a bit of a fuss and 2. call the Landratsamt again and remind them of their municipal supervisory duty and ask who you can file a complaint with (Kommunalbeschwerde) – that usually helps.
