Hello dear builders,

we live in BaWü and have submitted our building application. It includes a carport planned on the border, which complies with all the criteria of the state building regulations (height, facade area, length, ...) and the development plan.

Now our question is, does the future neighbor still have to agree, even though we comply with all regulations?

No. However, the wording of neighbor participation in §55 of the State Building Code could have significantly facilitated the processing of the building application if neighbor consents had been obtained beforehand through signatures on the building documents. A cautious caseworker will involve the neighbors on their own initiative if the signatures are missing, which can then lead to delays.
If you present your building project to the neighbors yourself, you also get to know them and have the chance to prevent suspicion and avoid misunderstandings.
