Are subsequent development costs possible or not?

Hello everyone!

We moved into our single-family home in January 2017. A former strip of farmland was developed to build 12 single-family houses. Opposite this new row of houses, there is an established residential area with an industrial area behind it. It is planned that, once all the houses are eventually completed, the road surface will be renewed. Now to my question:

According to the purchase contract, we bought the plot fully developed. Can the city charge us for the road renewal costs, or are the costs already covered by the purchase of the plot?

Thank you very much

Tobias

Road renewal is usually passed on to the residents, but it doesn't have to be. However, you are not automatically exempt.

If the costs for the road renewal are supposed to be included, this should also be mentioned in your purchase contract. Is there such a clause? The costs for the road renewal are allocated to the residents according to the size of the property and the usage of the respective road and have nothing to do with development costs. Unfortunately :(

It depends on what is regulated in the purchase contract and what the municipality has already regulated regionally on this... ** Initial development (if road expansion is conceptually included) is then covered; ** (later) road expansion (= making new) is often regulated on-site, for example, according to the road expansion statute of the respective municipality or district.
