first of all hello! after reading what felt like 1000 posts but somehow not getting an answer to my question anywhere, I hope I am in the right place here... unfortunately, "my" construction company also had to file for bankruptcy! Unlike dm and the like, they always played with open cards and advised me in time not to pay the last installment anymore! basically, we have still managed to get my house (only a few small things are missing), but the electrician performed his work incorrectly or defectively and now only wants to come to make corrections if I pay the remaining debt (~ 2500.-) that the company still owes him... so, now (finally) my question: my contracting party was the construction company xy their contracting party was the electrician abc WHO is now responsible for completion or remedying the defective work????? thanks in advance

great - the contracting party no longer exists.... and what about an ASSIGNMENT of the warranty in my favor?

The assignment could apply if the construction work has already been accepted, because the warranty begins to run from that point.

such a sh.... there is still no final report, which I need for the completion notice, does that now mean that NO warranty claims can be made????

I would say that unfortunately this is probably the case. Your contract, under which you can assert warranty claims, is with the insolvent company. The electrician does not owe you any warranty at all. If the company had not gone insolvent, it could have hired another electrician to fix the defects.

What if the company were not insolvent but simply shut down the business! Who can actually be held accountable then?
